Introduction

These Website Standard Terms and Conditions govern your use of CardMaker, an AI image editor and generator, accessible at https://cardmaker.org.

By using this website, you agree to accept all terms and conditions set forth here. You must not use this website if you disagree with any of these terms.

1. Intellectual Property Rights

Other than the content you own, under these Terms, CardMaker and/or its licensors own all the intellectual property rights and materials contained on this Website.

You are granted a limited license only for the purpose of viewing the material contained on this Website.

2. Restrictions

You are specifically restricted from all of the following:

  • Publishing any Website material in any other media
  • Selling, sublicensing, or otherwise commercializing any Website material
  • Publicly performing or showing any Website material
  • Using this Website in any way that is or may be damaging to this Website
  • Using this Website in any way that impacts user access to this Website
  • Using this Website contrary to applicable laws and regulations, or in any way that may cause harm to the Website, or to any person or business entity
  • Engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this Website
  • Using this Website to engage in any advertising or marketing
  • Generating, uploading, or distributing any sexually explicit, pornographic, NSFW (Not Safe For Work), or adult content of any kind. This includes but is not limited to nudity, sexual acts, or any content that violates applicable obscenity laws. Violations will result in immediate account termination.
  • Generating content that depicts minors in any sexual or inappropriate context
  • Generating content that promotes violence, hate speech, or illegal activities

Certain areas of this Website are restricted from being accessed by you, and CardMaker may further restrict access by you to any areas of this Website at any time, in its absolute discretion. Any user ID and password you may have for this Website are confidential and you must maintain confidentiality as well.

3. Your Content

“Your Content” shall mean any audio, video, text, images, or other material you choose to display on this Website. By displaying Your Content, you grant CardMaker a non-exclusive, worldwide irrevocable, sublicensable license to use, reproduce, adapt, publish, translate and distribute it in any and all media.

Your Content must be your own and must not infringe any third party’s rights. CardMaker reserves the right to remove any of Your Content from this Website at any time without notice.

4. No Warranties

This Website is provided “as is,” with all faults, and CardMaker expresses no representations or warranties of any kind related to this Website or the materials contained on this Website. Also, nothing contained on this Website shall be interpreted as advising you.

5. Limitation of Liability

In no event shall CardMaker, nor any of its officers, directors and employees, be held liable for anything arising out of or in any way connected with your use of this Website whether such liability is under contract. CardMaker, including its officers, directors and employees shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.

6. Indemnification

You hereby indemnify to the fullest extent CardMaker from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.

7. Severability

If any provision of these Terms is found to be invalid under any applicable law, such provision shall be deleted without affecting the remaining provisions herein.

8. Variation of Terms

CardMaker is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review these Terms on a regular basis.

9. Assignment

CardMaker is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

10. Entire Agreement

These Terms constitute the entire agreement between CardMaker and you in relation to your use of this Website, and supersede all prior agreements and understandings.

11. Governing Law & Jurisdiction

These Terms will be governed by and interpreted in accordance with the laws of the United States, and you submit to the non-exclusive jurisdiction of the state and federal courts located in the United States for the resolution of any disputes.

12. Content Safety & Moderation (Acceptable Use Policy)

CardMaker enforces a strict content safety policy. All user-supplied prompts are automatically screened by our content moderation system before any AI image, video, or music generation takes place. By using this service, you acknowledge and agree to the following Acceptable Use Policy:

12.1 Prohibited Content Categories

You may NOT use CardMaker to generate, attempt to generate, upload, store, or distribute any content that falls within the following categories:

  • Sexually Explicit / NSFW / Adult Content: Any content that is sexually explicit, pornographic, NSFW (Not Safe For Work), or of an adult nature is strictly prohibited. This includes, but is not limited to: nudity, partial nudity, sexual acts, simulated sexual acts, suggestive poses, fetish content, sexually suggestive text or imagery, or any content that could be classified as obscene under applicable laws. There are no exceptions to this rule.
  • Child Safety: Any content depicting, suggesting, or referencing minors in any sexual, suggestive, exploitative, or otherwise inappropriate context is absolutely forbidden. Any such attempt will result in immediate and permanent account termination and will be reported to the National Center for Missing & Exploited Children (NCMEC) and/or relevant law enforcement authorities.
  • Violence & Hate: Content that promotes, glorifies, or incites violence, terrorism, self-harm, suicide, hate speech, discrimination based on race, ethnicity, gender, religion, sexual orientation, disability, or any other protected characteristic, or illegal activities.
  • Deepfakes & Impersonation: Deceptive or misleading content intended to impersonate real individuals without their explicit consent, including non-consensual intimate imagery (NCII).
  • Harassment & Bullying: Content created to harass, threaten, intimidate, or bully any individual or group.
  • Illegal Activities: Content that promotes, facilitates, or depicts illegal activities, including but not limited to drug manufacturing, weapons creation, fraud, or any activity that violates applicable laws.

12.2 Automated Content Moderation

All prompts submitted to CardMaker's AI generation features are automatically screened through our content moderation system before any generation occurs. Prompts that are flagged or denied by our moderation system will be blocked, and no generation will take place. This screening applies to all generation types, including but not limited to image generation, video generation, and music generation.

12.3 Enforcement Actions

CardMaker reserves the right to take the following enforcement actions for violations of this Acceptable Use Policy:

  • Prompt Rejection: Prompts that violate this policy will be automatically blocked before generation.
  • Account Warning: First-time or minor violations may result in a warning.
  • Account Suspension: Repeated violations or serious violations may result in temporary or permanent account suspension.
  • Account Termination: Severe violations, including any attempt to generate CSAM (Child Sexual Abuse Material) or repeated attempts to circumvent moderation, will result in immediate and permanent account termination without refund.
  • Law Enforcement Reporting: Illegal content, particularly CSAM, will be reported to appropriate law enforcement agencies.

12.4 User Responsibilities

  • You are solely responsible for the prompts you submit and the content you generate using CardMaker.
  • You must not attempt to circumvent, bypass, or manipulate the content moderation system.
  • You must not use prompt engineering techniques specifically designed to evade content policy detection.
  • If you encounter content that violates this policy, please report it to support@cardmaker.org.

12.5 No Tolerance for NSFW Content

CardMaker maintains a zero-tolerance policy for NSFW, sexually explicit, pornographic, and adult content. This prohibition applies to all features of the platform, including but not limited to:

  • Text-to-image generation
  • Image-to-image generation
  • Video generation
  • Music generation (lyrics and prompts)
  • User uploads
  • Profile content

Any attempt to generate NSFW content, whether through direct prompts, obfuscated language, or any other method, is a violation of these Terms of Service and will be subject to the enforcement actions described above.

13. Third-Party AI Model Disclaimer

CardMaker uses third-party AI models to power its image generation features. These models may include technology provided by Google LLC and other AI providers. CardMaker is an independent service and is not affiliated with, endorsed by, sponsored by, or in any way officially connected with Google LLC or any of its subsidiaries or affiliates. The use of any third-party model names (including but not limited to "Gemini," "Nano Banana," and related names) is for descriptive purposes only and does not imply any partnership, sponsorship, or endorsement by those companies. All third-party trademarks and brand names are the property of their respective owners.

14. Fan Art, Third-Party Intellectual Property, and Commercial Rights Limitation

14.1 Commercial Rights Scope: Any commercial usage rights granted under CardMaker paid plans (including subscriptions and credit packs) apply strictly and solely to 100% original content, original characters, and materials for which you hold all necessary copyrights, trademarks, or licenses.

14.2 Third-Party Franchises and Trademarks: CardMaker offers design tools and style presets inspired by various popular card gaming aesthetics (including but not limited to Pokémon, Yu-Gi-Oh!, Magic: The Gathering, One Piece TCG, and Disney Lorcana). CardMaker is an independent platform and is not affiliated with, endorsed by, sponsored by, or officially associated with Nintendo, The Pokémon Company, Konami, Wizards of the Coast, Hasbro, Bandai Namco, Disney, Ravensburger, or any other trademark owner.

14.3 Non-Commercial Fan Creations: Any user creations that incorporate, reference, or depict third-party copyrighted characters, fictional worlds, logos, or registered trademarks are intended strictly for private personal enjoyment, non-commercial fan appreciation, home gaming playtests, and creative prototyping. CardMaker does not and cannot grant commercial rights, licensing, or authorization to sell, monetize, or commercially distribute fan-created cards derived from third-party intellectual property.

14.4 User Responsibility and Indemnification: You represent and warrant that you will not use CardMaker to produce infringing materials or commercially exploit content that infringes upon the intellectual property rights of any third party. You agree to bear sole legal responsibility and indemnify CardMaker for any claims, damages, or liabilities arising from your violation of third-party intellectual property rights.

15. Acceptable Use Policy

In addition to the content restrictions described in Section 2 and Section 12, your use of CardMaker is subject to our Acceptable Use Policy, which provides detailed guidance on permitted and prohibited content. The Acceptable Use Policy is incorporated into these Terms of Service by reference.
